GAme of Thrones: Shouldn't Jon Snow be executed for deserting the Night's Watch?

In the book, Jon’s decision to desert the Watch and lead an army of Wildlings south against Ramsay Bolton and the Warden of the North, Roose Bolton is exactly why he is executed.
But in the show, he takes that decision after he has been killed. He himself seems to think that,as he has literally died, his oath is fulfilled: he stayed at his post until death ended his Watch and now he is free to go.
And it is pretty much up to whoever is in charge to hang him or not. And that, apparently, is his friend, the unelected Edd Tollett.
But, even if it wasn’t Edd in charge, after seeing Jon Snow rise in vengeance after having died of multiple stabwounds, wouldn’t you think twice about stringing him up? You saw what happened to the last people who did that.
